OuiGotU Terms of Service
Last updated: TODO(confirm): publication date
These Terms are an agreement between you and TODO(confirm): legal name of the operating company, TODO(confirm): business address, Canada ("OuiGotU", "we", "us"). They apply to the OuiGotU apps and to the public seller pages at https://app.ouigotu.com (together, the "Service"). By creating an account or using the Service you accept these Terms and our Privacy Policy (https://ouigotu.com/privacy). If you do not accept them, do not use the Service.
1. What OuiGotU is — and is not
1.1 OuiGotU is a marketplace that helps people looking for local services ("buyers") find and contact people and businesses offering them ("sellers"), send booking requests, receive quotes and chat.
1.2 OuiGotU is not a party to any booking. The contract for a service is made directly between the buyer and the seller. OuiGotU does not provide the services, does not employ or act as agent for sellers, and does not guarantee the quality, safety, legality or timing of any service, or that a buyer or seller will honour a booking.
1.3 Payment is offline. The buyer pays the seller directly, by a method they agree on (for example cash or Interac e-Transfer). OuiGotU does not collect, hold or transfer any money, and does not offer deposits, escrow, refunds or cancellation penalties. Prices, quotes and invoices shown in the Service record what the parties agreed; any dispute about payment is between them.
1.4 No fees in this version. OuiGotU is free for buyers and sellers. There are no subscriptions or in-app purchases in this version. If we introduce paid features, we will tell you in advance and they will be optional.
2. Eligibility and accounts
2.1 You must be at least 18 years old and able to enter into a binding contract to use the Service.
2.2 You must give accurate information and keep it up to date. You are responsible for keeping your password secret and for everything done with your account. Tell us right away at support@ouigotu.com if you think someone else is using it.
2.3 One person, one account. You can use the same account as a buyer and as a seller; switching mode does not change these Terms.
3. Sellers
3.1 Sellers are solely responsible for their listings, prices, availability and services, and for holding every licence, registration, permit and insurance their trade requires in their province. A licence or registration number shown in the Service must be valid and yours.
3.2 Sellers must describe their services honestly, honour the bookings they confirm, and comply with all laws that apply to them, including consumer protection, tax and privacy laws for the buyer information they receive.
3.3 Invoices sent through the Service must reflect the amount agreed with the buyer. Sellers are responsible for their own taxes.
4. Buyers
4.1 Buyers must give accurate booking details (including the address for a service done at their place) and be present, or cancel in time, as agreed with the seller.
4.2 Cancellations are recorded. A cancellation less than 24 hours before the start counts toward your 24-hour cancellation rate, which the people you book with can see. OuiGotU charges no money for a cancellation.
5. Content and conduct
5.1 "Content" means anything you post or send through the Service: listings, photos, descriptions, reviews, messages, quotes and reports. You keep ownership of your Content. You give OuiGotU a non-exclusive, royalty-free, worldwide licence to host, store, display and reproduce it as needed to operate and promote the Service (for example showing a seller's public page). This licence ends when the Content is deleted, except for copies the other party keeps in their bookings, chats and reviews (see the Privacy Policy, section 7).
5.2 We have zero tolerance for objectionable content and abusive users. You must not post or send Content that:
- is false, misleading or fraudulent, including fake reviews or fake listings;
- is hateful, harassing, threatening, sexually explicit or violent, or discriminates against anyone;
- infringes anyone's intellectual property, privacy or other rights;
- offers services or goods that are illegal or that you are not allowed to provide;
- is spam, or tries to move users to another platform to avoid these Terms;
- contains malware or tries to access accounts, data or systems without permission.
5.3 Reporting and blocking. You can report a user, a listing, a review or a message from the "Report" menus, and block a user from the chat. We review reports TODO(confirm): "within 24 hours" and may remove Content, restrict features or suspend or close accounts that break these Terms, with or without notice. You can also write to support@ouigotu.com.
5.4 Reviews must be about a real booking and your own experience.
6. Your account ending
6.1 You can delete your account at any time in the app (My profile → Delete account). Deletion is refused while a booking is still open. Accounts created with Sign in with Apple are deleted from the app on an iPhone or iPad. What is deleted and what stays, anonymized, for the other party is explained in the Privacy Policy.
6.2 We may suspend or close your account if you break these Terms, if the law requires it, or to protect users or the Service.
7. The Service
7.1 We work to keep the Service available and accurate, but it is provided "as is" and "as available". Listings, prices, distances and availability come from sellers or are estimates.
7.2 We may change, suspend or stop any part of the Service. We will tell you in advance of important changes when we reasonably can.
7.3 The Service shows information from third parties (for example maps opened in another app). Their own terms apply.
8. Liability
8.1 To the extent permitted by law, OuiGotU is not liable for (a) the services provided or not provided by sellers, the conduct of any user, or any payment between users; (b) indirect, incidental or consequential damages, or loss of profits, data or goodwill; or (c) more than TODO(confirm): cap, e.g. CAD 100 in total for any claim related to the Service.
8.2 Nothing in these Terms limits rights you have as a consumer that cannot be limited by contract, including under the Québec Consumer Protection Act. Some limitations above may not apply to you.
8.3 You agree to indemnify OuiGotU against claims by third parties caused by your Content, your services (if you are a seller) or your breach of these Terms, to the extent permitted by law.
9. Law and disputes
These Terms are governed by the laws of TODO(confirm): province, e.g. Québec and the federal laws of Canada that apply there. Disputes go to the courts of TODO(confirm): judicial district, unless the law gives you, as a consumer, the right to sue where you live.
10. Language
TODO(confirm): These Terms are available in English and French. The parties have required that these Terms and related documents be drawn up in English and French; in case of inconsistency, TODO(confirm): which version prevails prevails. / Les parties ont exigé que les présentes et les documents qui s'y rattachent soient rédigés en anglais et en français.
11. Changes to these Terms
We may update these Terms. We will post the new version at https://ouigotu.com/terms with its date and tell you in the app or by email at least TODO(confirm): 30 days before important changes take effect. If you keep using the Service after that, the new Terms apply; if you do not agree, you can delete your account.
12. Apple
If you downloaded the app from the App Store: these Terms are between you and OuiGotU, not Apple; Apple is not responsible for the app or its content and has no obligation to provide support for it; Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
